At Actuall, your privacy is a design principle — not a checkbox. This policy explains what data we collect, why we collect it, how we use it, and the rights you have over it. Please read it carefully.

1. Who We Are

Actuall is operated by Tunenexus Private Limited ("Actuall", "we", "us", or "our"), a company incorporated in India. We operate the Actuall mobile application and related services.

2. Information We Collect

2.1 Information You Provide Directly

2.2 Information We Collect Automatically

Device information	Device type, operating system, app version, device identifiers
Location data	Approximate location (city/region) used for location-based Circle discovery — only when you grant permission
Log data	IP address, access times, error logs
Voice activity	Voice rooms in Circles are live and not recorded by default. If reports trigger a review, brief audio segments may be reviewed by our Trust & Safety team.

2.3 Information from Third Parties

If you sign in using a third-party service (e.g. Google), we receive basic profile information from that service consistent with your permissions there.

3. How We Use Your Information

To provide the service — running the app, showing you Circles and Moments, enabling real-time voice and chat features
To personalise your experience — showing you Circles relevant to your interests, location, and social connections
To send prompts and notifications — delivering Moment prompts and activity alerts
To keep the platform safe — detecting abuse, enforcing our policies, reviewing reported content
To communicate with you — sending service-related messages, support responses, and policy updates
To improve the product — analysing usage patterns to fix bugs and build better features
To comply with law — meeting our obligations under applicable Indian laws and regulations

4. How We Share Your Information

We do not sell your personal data. We share it only in the following circumstances:

With other users — your profile, Moments, and Circle activity are visible to others according to your privacy settings
With service providers — trusted third parties who help us operate the platform (cloud hosting, analytics, push notifications) under strict data processing agreements
For legal compliance — when required by law, court order, or to protect rights and safety, including cooperation with law enforcement
In a business transfer — if Actuall is acquired or merges with another entity, user data may transfer as part of that transaction. We will notify you in advance.

5. Data Retention

Moments — automatically deleted after 24 hours from all systems (consistent with the product design)
Circles — Circle chat and media is deleted when a Circle expires
Account data — retained while your account is active; deleted within 30 days of account deletion, except where retention is required by law
Safety records — reports, bans, and enforcement records may be retained for longer to protect the platform

6. Your Rights

Under applicable Indian data protection law and our own commitments, you have the right to:

Access — request a copy of the personal data we hold about you
Correction — ask us to correct inaccurate information
Deletion — request deletion of your account and personal data
Portability — receive your data in a structured, machine-readable format
Withdraw consent — withdraw location access or notification permissions at any time through your device settings
Lodge a complaint — with the relevant data protection authority if you believe your rights have been violated

7. Location Data

Location is used solely to surface relevant local Circles and location-tagged content. We collect only approximate location (city/region level) unless precise location is required for a specific feature you opt into. You can disable location access at any time in your device settings without losing core app functionality.

8. Children's Privacy

Actuall is not intended for users under the age of 18. We do not knowingly collect personal data from minors. If we learn that a minor has created an account, we will promptly delete the account and associated data. If you believe a minor is using our platform, contact us at safety@actuall.app.

9. Data Security

We implement industry-standard technical and organisational measures to protect your data, including encryption in transit and at rest, access controls, and regular security audits. No system is completely secure; if you suspect a security issue, contact us immediately at security@actuall.app.

10. Third-Party Links and Services

Actuall may link to external websites or services. We are not responsible for the privacy practices of those services. We encourage you to review their privacy policies separately.

11. Changes to This Policy

We may update this policy periodically. When we make material changes, we will notify you via in-app notification or email at least 14 days before changes take effect. Continued use of Actuall after that point constitutes your acceptance of the updated policy.
