1. About Actuall

Actuall is a real-time social platform operated by Tunenexus Private Limited ("Actuall", "we", "us", or "our"), incorporated under the laws of India. Actuall enables users to share prompt-driven Moments and join temporary group spaces called Circles for real-time interaction.

2. Eligibility

To use Actuall, you must:

• Be at least 18 years of age
• Be legally permitted to use social media services under the laws of your jurisdiction
• Not have been previously banned or removed from Actuall
• Provide accurate and truthful information during registration

By creating an account, you confirm that you meet these requirements. Actuall reserves the right to suspend or terminate accounts where eligibility cannot be confirmed.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately at support@actuall.app if you suspect unauthorised access to your account
• You may not transfer your account to another person
• Actuall accounts are personal and non-commercial unless you have entered into a separate business agreement with us

4. Acceptable Use

When using Actuall, you agree to act in good faith and follow our Community Guidelines. Specifically, you agree not to:

4.1 Content Prohibitions

• Post, share, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Share or solicit child sexual abuse material (CSAM) or content that sexualises minors in any way
• Post nudity or sexually explicit content
• Incite violence, hatred, or discrimination based on race, religion, gender, sexual orientation, caste, or nationality
• Spread misinformation or deliberately false content that could cause public harm
• Share another person's private information without their consent (doxxing)

4.2 Behaviour Prohibitions

• Harass, bully, stalk, or intimidate other users
• Impersonate any person, brand, or entity
• Use Actuall for commercial solicitation, spam, or unsolicited advertising without written permission
• Attempt to manipulate, game, or exploit the XP, leaderboard, or discovery systems
• Create multiple accounts to circumvent a ban or for any other deceptive purpose

4.3 Technical Prohibitions

• Reverse-engineer, decompile, or attempt to extract the source code of the app
• Use automated tools, bots, or scripts to access or interact with Actuall
• Attempt to interfere with the security, integrity, or availability of the platform
• Scrape or collect data from Actuall without our express written permission

5. Content Ownership and Licence

5.1 Your Content

You retain ownership of all content you create and post on Actuall ("Your Content"). By posting content on Actuall, you grant us a non-exclusive, royalty-free, worldwide, sublicensable licence to use, host, display, reproduce, and distribute Your Content for the purposes of operating and improving the platform.

This licence ends when you delete your content or your account, subject to our retention obligations (see Privacy Policy).

5.2 Content Standards

You represent that Your Content does not infringe any third-party intellectual property, privacy, or other rights. You are solely responsible for the content you post.

5.3 Actuall's Content

All platform design, software, features, branding, and Moment prompts are owned by or licensed to Actuall. You may not copy, reproduce, or use these without our written permission.

6. Circles and Moments — Platform Features

6.1 Circles

Circles are temporary group spaces. They expire automatically at the end of their set duration. By joining a Circle, you acknowledge that:

• Other Circle members can see your activity and messages within that Circle
• The Circle creator and moderators can remove you at any time
• Other members may report or vote to remove you if you violate community standards

6.2 Moments

Moments are ephemeral posts in response to shared prompts. Moments expire after 24 hours. By posting a Moment, you acknowledge that:

• Your Moment may be visible to other users based on your privacy settings
• Other users may react, comment, or share your Moment before it expires
• Moments must comply with our content standards

6.3 Voice Rooms

Voice rooms within Circles are live and ambient. By joining a voice room, you consent to other Circle members hearing you. Voice rooms are not recorded by default.

7. Moderation and Enforcement

Actuall reserves the right to remove any content, suspend, or permanently ban any account that violates these Terms or our Community Guidelines, without prior notice. Actions we may take include:

• Content removal
• Warning issuance
• Temporary or permanent account suspension
• Reporting to law enforcement where legally required

If you believe a moderation action was made in error, you may appeal to support@actuall.app.

8. Third-Party Services

Actuall may integrate with or link to third-party services (e.g. sign-in providers, analytics). These services operate under their own terms and privacy policies. Actuall is not responsible for the practices of third-party services.

9. Disclaimer of Warranties

10. Limitation of Liability

To the fullest extent permitted by applicable law, Actuall shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of goodwill, or service interruptions.

Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Actuall and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from or related to these Terms shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in [City], India.

Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top and notify you via in-app notification for material changes. Continued use of Actuall after the effective date of changes constitutes your acceptance of the revised Terms.

14. Termination

You may delete your account at any time through the app settings. Actuall may terminate or suspend your access at any time for violation of these Terms or for any other reason at our discretion.

Upon termination, your licence to use Actuall ends immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and governing law) will remain in effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and CSAE Policy, constitute the entire agreement between you and Actuall regarding your use of the platform and supersede all prior agreements.
